Terms of service
These terms govern your use of busyip, a prepaid proxy service operated by EFIRITY PTE. LTD.. Please read them with the Acceptable Use Policy, which is short, specific, and the document we will actually enforce.
1. Who you are contracting with #
1.1 busyip is operated by EFIRITY PTE. LTD.. The registered particulars of the contracting entity are set out at the foot of this page and on every invoice.
1.2 "We", "us" and "our" mean that entity. "You" means the account holder and anyone using the service through your account.
2. The agreement #
2.1 Your agreement with us consists of these terms, the Acceptable Use Policy and the Privacy Policy. Where they conflict, the Acceptable Use Policy prevails on questions of permitted and prohibited use, and these terms prevail on everything else.
2.2 You accept the agreement when you create an account. We record which version you accepted and when; the version identifier is at the top of each page.
2.3 We may change these terms. Where a change materially affects your rights we will email the address on your account before it takes effect. Continuing to use the service after that date is acceptance. If you do not accept a change, you may close your account under section 10.
3. Your account #
3.1 One account per email address. You must give a working email address and confirm it. Confirming the address activates the account: there is no approval step and no waiting for a human.
3.2 One active proxy credential per account, for the life of the account. You can rotate the secret on that credential yourself, at any time, from your dashboard. You cannot hold two credentials at once, and rotating does not create a second one.
3.3 You are responsible for keeping your dashboard password and your proxy secret confidential, and for everything done through them. Your dashboard password and your proxy secret are unrelated credentials: resetting one does not change the other.
3.4 You must give accurate information at signup, including the use case you select, and keep it accurate. The use case you select is the basis on which we supply the service.
3.5 New accounts receive a one-time free allowance of 1 GiB (1,073,741,824 bytes) as a gift, subject to a monthly limit on how much we give away in total. If that limit is reached the account is still created and still works; you can buy a pack immediately and we will email you when free credit is available again. The free allowance carries no entitlement and no cash value.
4. What the service is #
4.1 busyip sells prepaid, non-expiring, byte-denominated access to mobile and residential proxies. You buy a number of gigabytes; you use them whenever you like; they do not expire and there is no monthly fee and no subscription.
4.2 1 GB means 1,073,741,824 bytes (230) throughout this agreement, on the pricing page, in your dashboard and in every invoice.
4.3 We count bytes on the wire between your client and our gateway, including TLS framing. Our figure will typically read 2 to 8 per cent above your own application's counter, because your application counts payload and we count what actually crossed the connection. A larger gap than that is a bug: tell us, and we will investigate and credit you.
4.4 Usage decrements a byte balance. It never touches money. Money moves once, when you buy a pack, at an exact number of cents. There is no per-request rounding and no minimum billable unit.
4.5 If a transfer overshoots your balance slightly, we allow a small grace rather than cutting the connection mid-stream, and we carry the overshoot against your next purchase rather than invoicing you for it.
4.6 We do not guarantee availability, throughput, latency, the availability of any particular country or network, or that any specific destination will be reachable. The IP addresses are real people's connections and they come and go. This is the honest trade behind the prepaid model: when nothing is available you burn no balance and you owe us nothing. If you need a guaranteed-capacity arrangement, this is not the product, and we would rather say so here than after you have paid.
4.7 We do not inspect the content of your traffic.
5. Permitted use #
5.1 You may use the service only for the following purposes:
- Market and pricing research.
- Brand and counterfeit protection.
- Ad verification.
- Search-result and availability checking.
- Cybersecurity testing of systems the customer is authorised to test.
5.2 That list is exhaustive, and section 2.3 of the Acceptable Use Policy explains why: the people whose connections you are using were told exactly this list before they agreed to supply them. We cannot sell you a use they did not agree to.
5.3 Within those purposes, you may collect only information that is published to the public and reachable without a login, a paywall or any other access control.
6. Prohibited use #
6.1 The Acceptable Use Policy sets out what you must not do. It is specific rather than gestural, and it is part of this agreement.
6.2 You are responsible for all traffic sent through your credential, including traffic sent by anyone else who has it.
6.3 Breaching the Acceptable Use Policy is a material breach of this agreement and entitles us to act under section 9 immediately.
7. Prices, payment and tax #
7.1 Prices are those shown on the pricing page at the time you buy. They are per pack, in US dollars, and they are charged in full at purchase.
7.2 Payments are processed by Stripe. We never see or store your full card details; Stripe does, under its own terms and privacy policy. We store a record of the purchase, the amount, and an identifier that lets us match a payment to your account.
7.3 Prices exclude tax. We are not currently registered for Singapore GST, because our turnover is below the S$1 million registration threshold, so no GST is charged or shown. If that changes, we will say so and prices will show tax separately. You are responsible for any tax, duty or withholding that applies to you in your own jurisdiction, including any reverse-charge obligation.
7.4 Your balance is credited when Stripe confirms the payment, not when your browser returns from the payment page. In the ordinary case that is a difference of seconds. If your card is charged and your balance does not move within a few minutes, email support@busyip.com and we will fix it.
7.5 Bytes do not expire. There is no auto-recharge and no recurring charge; every purchase is a separate act by you.
7.6 Invoices carry our registered name, our Unique Entity Number and our registered address, and are available in your dashboard.
8. Refunds #
8.1 Refunds are discretionary and handled by support. There is no self-serve refund button and no stated refund window. Email support@busyip.com and a person will read it.
8.2 We say that plainly rather than advertising a window we would then have to police. The free allowance in section 3.5 is there so you can find out whether the product works for you before paying anything.
8.3 Where we do grant a refund, it covers unused bytes only, valued at the volume-weighted average price you paid for the bytes remaining in your balance, rounded up to the cent in your favour. We reduce your balance before returning the money.
8.4 Closing your account does not automatically refund an unused balance. If you are closing an account with a balance you want back, ask us before you close it.
8.5 Nothing in this section removes a statutory right you have that cannot be excluded by agreement. Whether such a right applies to you depends on where you are and whether you are buying as a business or as a consumer. See section 13.
9. Suspension and termination #
9.1 We may suspend or terminate your account and revoke your credential immediately, without prior notice and without refund, on a first breach of the Acceptable Use Policy or on a reasonable suspicion of one. Clause 5.2 of that policy explains why the right is written that broadly.
9.2 We may also suspend an account where a payment is disputed or reversed, where we are required to by law, or where continuing to supply the service would expose a person supplying a connection to material risk.
9.3 If we suspend you we will tell you why, and you may reply to support@busyip.com. If we conclude we were wrong we will restore the account and the balance.
9.4 A suspended account remains readable: your usage history and invoices stay available to you.
10. Closing your account, and what we keep #
10.1 You can close your account yourself from your settings page, at any time, without asking us.
10.2 Closing takes effect immediately. Your credential is revoked, any no new connection is accepted, and your sessions end. The account becomes read-only and your usage and invoices remain exportable for 30 days.
10.3 At 30 days we erase your email address and the associated login record, together with our funnel telemetry and the records used to police the free allowance.
10.4 We keep the financial records — purchases, invoices, and the byte and money ledgers — for as long as the law requires us to, which is seven years. They are kept without your email address, linked only to an opaque account identifier. We are required to keep an auditable accounting record, and erasing the link to a person satisfies a deletion request without making the books unauditable.
10.5 An unused balance is not refunded automatically on closure. See section 8.4.
10.6 The Privacy Policy sets this out in full, with the retention period for every category of data.
11. Changes to the service #
11.1 We may change, add to, or withdraw parts of the service. If we withdraw the service entirely, we will give you notice by email and refund any unused balance at the price you paid for it.
11.2 Section 11.1 is the one refund we commit to in advance, because it is the one case where you cannot use what you bought through no choice of your own.
12. Governing law and disputes #
12.1 This agreement is governed by the law of Singapore.
12.2 The forum for a dispute is Singapore.
12.3 The mechanism — whether a dispute goes to the courts of Singapore or to arbitration seated in Singapore — is not yet settled. See section 13. Until it is, nothing in this agreement requires you to arbitrate or waives any right you have to bring a claim in a court that would otherwise have jurisdiction.
12.4 Before starting a formal dispute, please email support@busyip.com. Most things that reach this section are billing questions with a factual answer, and we would rather answer it.
13. Three clauses are not yet settled #
We would rather show you a gap than fill it with boilerplate nobody at this company has actually decided. Three clauses that most terms of service contain are deliberately absent from this version:
- Limitation of liability — not stated. This document contains no cap on, and no exclusion of, our liability to you. That is a gap in the drafting, not a position: it means our liability is whatever the governing law provides, unlimited by agreement. A cap will be added in a future version and will not apply retrospectively to anything that happened before it takes effect.
- Dispute mechanism — not chosen. Governing law and forum are settled as Singapore (section 12). Whether disputes are heard by the Singapore courts or by arbitration seated in Singapore has not been decided, so neither is imposed.
- Eligibility — not stated. We have not fixed a minimum age for an account, and we have not stated whether the service is offered only for business use. Both are under consideration and both will be added explicitly rather than assumed.
These will be settled with legal advice, published as a new version, and notified under section 2.3 before they take effect.
